PayGate.to DOES NOT process payments, DOES NOT hold funds, DOES NOT transmit funds, DOES NOT store digital assets, and DOES NOT act as a payment service provider (PSP), merchant of record, acquiring institution, financial intermediary, money services business, or custodian under any jurisdiction.
PayGate.to operates strictly as a software provider and technical integration facilitator.
NATURE OF SERVICES
- PayGate.to provides software tools designed solely to facilitate API communication between a merchant’s system and independent third-party financial or cryptocurrency service providers.
- All financial transactions are executed exclusively by third-party providers operating under their own regulatory licenses, compliance frameworks, and internal risk controls.
- PayGate.to DOES NOT participate in authorization, settlement, clearing, fund holding, fund routing, chargeback handling, dispute resolution, compliance screening, or transaction approval decisions.
- The software is provided strictly “as is” for interoperability purposes without warranties of any kind.
CRYPTOCURRENCY & DECENTRALIZED INFRASTRUCTURE
Where cryptocurrency integrations are supported, transactions occur on decentralized blockchain networks. These networks operate independently through distributed ledger technology and are NOT owned, operated, administered, or controlled by PayGate.to.
- PayGate.to DOES NOT control blockchain networks or validate transactions.
- PayGate.to DOES NOT hold private keys or provide wallet custody services.
- PayGate.to DOES NOT have the ability to freeze, reverse, redirect, recover, or modify cryptocurrency transactions.
- Cryptocurrency transfers are irreversible once confirmed on the blockchain.
- All wallet, exchange, custody, and payout services are provided exclusively by independent third-party infrastructure providers.
Due to the decentralized and immutable nature of blockchain technology, PayGate.to has NO AUTHORITY and NO TECHNICAL CAPABILITY to interfere with confirmed transactions.
REGULATORY & LAW ENFORCEMENT REQUESTS
PayGate.to DOES NOT possess customer funds, DOES NOT control transaction settlement, DOES NOT maintain KYC/AML documentation belonging to payment processors, and DOES NOT have custody access to digital assets.
PayGate.to DOES NOT store, retain, or maintain transaction logs, payment records, blockchain records, or API request logs relating to financial processing activities.
Requests relating to account freezes, fund seizure or recovery, disputes, chargebacks, compliance documentation, or transaction reversals must be directed to the licensed payment provider or cryptocurrency service provider that executed the transaction.
Official legal requests directed to PayGate.to must include proper legal authority, jurisdictional basis, and valid supporting documentation. Informal, incomplete, or improperly served requests will not be processed.
MERCHANT RESPONSIBILITY
Merchants using PayGate.to software are solely and exclusively responsible for ensuring compliance with all applicable laws, regulations, licensing requirements, tax obligations, consumer protection standards, and anti-money laundering requirements within their jurisdiction.
PayGate.to ASSUMES NO RESPONSIBILITY and ACCEPTS NO LIABILITY for the business practices, compliance status, financial conduct, regulatory standing, or activities of its users.
NOTICE TO THIRD-PARTY SERVICE PROVIDERS
PayGate.to provides neutral software infrastructure enabling API connectivity between independent systems. PayGate.to DOES NOT control, supervise, endorse, manage, or monitor the business activities of merchants utilizing third-party APIs through our software tools.
If any third-party service provider determines that a merchant’s use of its API violates internal policies, contractual terms, or compliance requirements, it is solely that provider’s legal responsibility to implement appropriate technical and legal measures, including suspension or revocation of API credentials, authentication keys, tokens, or system access.
PayGate.to has NO AUTHORITY and NO OBLIGATION to enforce policy decisions, restrict integrations, or disable connectivity on behalf of independent service providers.
Absent a valid court order or legally binding directive, there is no general prohibition under applicable law preventing a publicly accessible website from directing traffic or API requests to another system that has not been properly restricted, authenticated, encrypted, or technically secured by its operator. Service providers remain solely responsible for implementing and enforcing their own access controls, authentication systems, encryption standards, firewall protections, and security mechanisms.
Accordingly, PayGate.to shall NOT be held liable for any failure by a third-party provider to enforce its own technical safeguards, contractual limitations, or regulatory compliance controls.
